Source Code License Agreement

This Source Code License Agreement applies only if JordanMurrayDev separately provides you with access to any DRIFT source code, repository, archive, or related materials. By accessing, downloading, or using that source code, you agree to the terms below.

1. Scope

This agreement governs source code provided for the DRIFT app and related supporting materials, excluding third-party open-source components that are licensed under their own terms.

2. License grant

Subject to your compliance with this agreement and any applicable commercial terms, JordanMurrayDev grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

  • access and review the DRIFT source code internally
  • compile, run, and modify the source code for your own internal business use
  • use the source code only in connection with your authorized use of DRIFT

3. Restrictions

You may not, except as expressly permitted in writing:

  • sell, sublicense, distribute, publish, or otherwise make the source code available to third parties
  • use the source code to build or commercialize a competing product or service
  • remove or alter copyright, trademark, or proprietary notices
  • provide repository access to anyone other than your employees or contractors who need access and are bound by confidentiality obligations

4. Ownership

DRIFT and its source code remain the property of JordanMurrayDev and its licensors. No ownership rights are transferred to you under this agreement.

5. Confidentiality

The DRIFT source code is confidential information. You must protect it using reasonable security measures and disclose it only to personnel who require access for permitted use and who are bound by written confidentiality obligations.

6. Open-source components

The source code may include or depend on third-party open-source software. Those components are licensed under their own applicable terms, which continue to govern your use of those components.

7. Support and updates

Unless separately agreed in writing, JordanMurrayDev is not obligated to provide maintenance, support, updates, or new versions of any source code made available under this agreement.

8. Termination

This license terminates automatically if you breach this agreement. JordanMurrayDev may also terminate or suspend access if reasonably necessary to protect its rights, customers, systems, or intellectual property.

9. Effect of termination

On termination, you must stop using the source code and permanently delete or destroy all copies in your possession or control, except to the extent a copy is retained solely as part of routine backup systems and remains subject to this agreement.

10. Disclaimer

The source code is provided on an "as is" and "as available" basis to the maximum extent permitted by law. JordanMurrayDev disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

11. Limitation of liability

To the maximum extent permitted by law, JordanMurrayDev will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, or business opportunity arising from or related to the source code.

To the maximum extent permitted by law, JordanMurrayDev's total liability arising out of or relating to the source code will not exceed the amount you paid for access to DRIFT in the 12 months preceding the claim. If you have not paid anything, total liability will not exceed GBP 100.

12. Governing law

This agreement is governed by the laws of England and Wales, excluding conflict of laws rules. The courts of England and Wales will have exclusive jurisdiction, unless applicable law requires otherwise.
